Overview

A class action settlement (the “Actions”) is now pending in proceedings in the Superior Court of the State of California for the County of San Diego (the “Court”), entitled Jasmin Reece, et al. v. Chart One, Inc., Case No. GIC864290 and Melissa Jackson v. ChartONE, Inc., et al., Case No. GIC864155. In the Actions, the Representative Plaintiffs allege that by overcharging for copies of patient’s records, the Settling Defendant violated California Evidence Code §1158. The Representative Plaintiffs seek injunctive relief, damages, and other relief. ChartOne has denied and continues to deny each and all of the claims, allegations and contentions alleged by the Representative Plaintiffs in the Actions.

A settlement has been preliminarily approved by the Court. Under the Settlement, ChartOne has agreed to reimburse each Settlement Class Member who submitted a timely claim with reasonable proof of payment the amount of $28.00 per occurrence and has agreed to comply with California Evidence Code §1158 when a request for patient’s records is made pursuant to that Section. If you wanted to participate in the Settlement, you must have signed and submitted a Claim Form to the Claims Administrator postmarked by July 11, 2008.

The members of the Settlement Class are the Representative Plaintiffs and all other Persons who, at any time between April 11, 2002 and through March 1, 2007, prior to the filing of an action or the appearance of a Defendant in an action requested copies of his or her patient records from a Released Medical Provider as defined in the Stipulation of Settlement and listed on Exhibit A of the Notice and/or ChartOne pursuant to Evidence Code §1158 and were charged and paid an amount to ChartOne in excess of the “reasonable cost” set forth in Evidence Code §1158. Excluded from the Settlement Class are all persons who properly and timely elected to opt out pursuant to the terms of the Settlement. Claim Form

The deadline to submit a Claim Form was July 11, 2008. If the Settlement is granted final approval, you will be contacted regarding your claim. If you did not timely file a claim form, and you did not opt out, you will still be bound by the Settlement, including any releases and assignments of your claims effectuated thereby.

Exclusions & Objections

If you wished to exclude yourself (or opt out) from the Settlement Class, you must have submitted a letter requesting exclusion by July 11, 2008. Objections to the Settlement or requests to speak at the Hearing must have been filed with the Court and served on counsel for the Parties on or before July 11, 2008.

Fairness Hearing

The Honorable Jay M. Bloom will hold a Final Approval hearing on July 25, 2008 at 11:00 a.m. in Department 70 of the San Diego Superior Court, which is located at 330 West Broadway, San Diego, California 92101.
